1. Acceptance of Terms

By accessing or using Masq ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Masq provides AI-powered real-time identity transformation services, allowing users to create and transform their appearance in real-time for gaming, streaming, and personal expression. All transformations occur in real-time using your device's camera. The Service does not require or accept uploaded images or videos.

3. User Accounts and Eligibility

You must be at least 18 years old to use the Service. To use certain features of the Service, you may be required to create an account. You agree to:

  • Be at least 18 years of age
  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the Service to impersonate real individuals for deceptive purposes or to create deepfakes intended to mislead or defraud others
  • Use the Service for illegal, harmful, or fraudulent purposes
  • Attempt to reverse engineer, decompile, or exploit the Service
  • Use the Service in a way that violates any applicable law or regulation
  • Harass, abuse, or harm others using transformed identities
  • Circumvent any age verification or account security measures

5. Intellectual Property and Commercial Use

All AI-generated identity transformations, technology, and related intellectual property are the proprietary property of Masq. The Service itself (including the AI models, transformation engine, and software) may not be reverse engineered, redistributed, or commercially exploited.

Commercial Use Rights: You are granted a non-exclusive, worldwide license to use your transformed identities for both personal and commercial purposes, including but not limited to:

  • Streaming and content creation (Twitch, YouTube, etc.)
  • Sponsored content and brand partnerships
  • Gaming and esports competitions
  • Social media content monetization

You own the content you create while using the Service. No revenue sharing or royalties are required for commercial use of your transformed content.

6. Virtual Goods and Purchases

The Service operates on a freemium model with optional paid features:

  • Free Tier: All users receive one (1) face identity at no cost
  • Additional Faces: Users may purchase additional face identities
  • Full Body Identities: Users may purchase full body transformation capabilities

Payment Terms: All purchases are final. Virtual goods (identities, transformations) are non-refundable once generated. Payment processing is handled by third-party providers, and you agree to their terms of service.

Prices are subject to change at our discretion. We will provide notice of price changes for future purchases, but existing purchases are not affected.

7. Privacy and Data

Your use of the Service is subject to our Privacy Policy. We process camera data and personal information in accordance with applicable privacy laws and our stated policies.

8. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Termination and Account Deletion

We may terminate or suspend your access to the Service at any time for violation of these Terms or for any other reason. You may delete your account at any time through your account settings.

Upon account deletion, your account data will be retained for 30 days to allow for account recovery. After 30 days, all account data will be permanently deleted. Purchased virtual goods are non-refundable and will be deleted with your account. Your right to use the Service ceases immediately upon termination or deletion.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.

12. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Nevada, rather than in court, except that you may assert claims in small claims court if your claims qualify.

No Class Actions: You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration Rules: Arbitration shall be conducted by a neutral arbitrator in accordance with the American Arbitration Association's (AAA) rules. The arbitrator's decision will be final and binding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@masq.com within 30 days of creating your account. If you opt out, disputes will be resolved in Nevada courts.
